HAYDEN, Idaho — Kootenai County Sheriff's Office Deputies were called to the 8600 block of Government Way in Hayden after reports of a 3-year-old child without socks or shoes and dressed only in pajamas walking along the road.

Detective Dennis Stinebaugh said deputies found a shivering 2-year-old boy with a dirty face, cold to the touch and not wearing socks or shoes.

Stinebaugh said the child had attempted to cross Government Way to see the “Tonka Trucks”, which were large pieces of construction equipment across the street.

Stinebaugh also said deputies located the child’s father Castulo P. Costilla, 28, in a nearby apartment with the front door open. Officials said he was passed out on couch.

The detective said they woke Costilla and he told deputies that he’d been using methamphetamine, had been awake for two days, consumed heavy amounts of alcohol the night before and then smoked marijuana earlier in the morning before falling asleep.

Deputies said they found methamphetamine in the residence. According to the report, the drug was near the child's toys.

Deputies said Costilla also had possession of a handgun after they discovered he had been storing a loaded pistol under the bed in the apartment without permission of the apartment's owner.

Costilla was arrested and charged with felony injury to child, possession of methamphetamine, possession of marijuana, illegal possession of prescription medication and possession of paraphernalia.

Costilla faced a judge Monday afternoon for the three charges.

Costilla has a criminal history including two previous injury to child charges in 2011 and 2012. He also has numerous probation violation convictions, felony drug charges and an arrest in 2014 for domestic battery. Costilla also has previous felony charges out of California and Arizona.

Deputies said the child is now safe and with other family members.

KREM 2 spoke with the mother of the child off-camera. She said the toddler was a little traumatized after what happened, but is doing ok. She said she had a split custody of the child as part of their child support agreement.

She also said she was surprised at what happened and had not been aware Costilla had relapsed and was taking meth again. She said he is a good, attentive father when sober.

The judge Monday ordered Costilla be kept in jail for now, and set his bond at $50,000.
