SPOKANE, Wash.-- Some changes are in store for erotic retailers in Spokane.

The Spokane City Council unanimously voted Monday to carefully define the parameters of an adult book or video store.  In the past, the city has had trouble enforcing where the shops can be located with regard to schools, parks, churches, and residential neighborhoods.

The city is currently involved in ongoing litigation with the Hollywood Erotic Boutique on Garland and Division.  Officials said the shop is situated too close to a local park.  But since the business doesn’t call itself an erotic bookstore, the owners don’t want to move.

Under the newly passed ordinance, a shop would be classified as adult only if 30% of its sales are pornographic or erotic items.  It will also apply to stores where 30% of the square footage carries adult merchandise.

The City said the Hollywood Erotic Boutique was already in violation of the current ordinance. However, the city council said making the limitations more clear may reduce future court battles.
