The Spokane County Superior Court lawsuit by Jane Marks seek unspecified damages from Dr. Mark C. Paxton, alleging he gave Marks general anesthesia in June 2007 without assessing risks or considering other prescription medications Marks was taking.
The 62-year-old Marks suffered cardiac arrest June 22, 2007 and died five days later.
Seattle lawyer John Versnel III represents Paxton. He said Friday he hadn't seen a copy of the lawsuit, but noted state investigators told Paxton he wasn't negligent in Marks' death.
His office says Paxton is in Guatemala for two weeks and unavailable for comment.
