SPOKANE -- A man is in jail after police found four pounds of marijuana in the back seat of his car.  The discovery happened during a routine traffic stop at 11:40 a.m. Sunday near the intersection of Sprague and Washington.

The officer ran the license plate on the white Honda Civic and believed he had a stolen Honda.  After further investigation, it was determined the driver's license status was suspended.  The driver was arrested and placed in the patrol car.  While doing an inventory of the vehicle to be towed, a strong odor of marijuana was detected coming from the vehicle back seat area.

The vehicle was secured and a County Drug Handler and Drug Dog responded.  The drug dog alerted on the vehicle two different times.

The officer wrote a search warrant for the vehicle and it was signed by a judge.  The search warrant was served on the vehicle and its contents.  A large black bag was found in the back seat and inside were four pounds of marijuana sealed in large plastic bags.

The driver, who had been booked in to jail earlier for suspended driving, was then charged with possession of marijuana with intent to deliver.

vociferous?? come on, is it really necessary to bring out the big guns in this forum? Blogs are for getting your point across, not exhibiting your english language skills. This isn't an intellectual debate, it is a discussion about a guy that was driving a stolen car, on a suspended license, with no insurance, and a criminal record! There is nothing intellectual about that.

Police had custody of the vehicle. Neither it nor it's contents were going anywhere. So why not make the smart decision. You hit the pause button, get a search warrant and seize the evidence all nice and legal like. That way later on down the road you don't have a defesne attorney coming along trying to get it tossed on a legal technicality. Spokane PD made the right call here.

If you don't want drugs on the streets tanker you better appeal to your government to destroy all alcohol outlets. Also, why are the people most vociferous in their anti-marijuana prejudices always the ones who have trouble communicating using the English language? Strange . . .

The protocol was followed. The search turned up ILLEAGAL DRUGS. I can not believe any one would argue against the law in this case. Do you want drugs on the streets? NO. Did the job , and solved a crime. All you naysayers need to get a life.

The fact remains, regardless of what you think about personal amounts of pot for possession for personal use, this guy is still a criminal, driving with a suspended license, no insurance, and has a criminal record. As for the search warrant deal, yes, more rights have been given to the criminals... I don't want to go into it because I don't want criminals using it to get out of jams they get into by being a criminal.

Silly Fourth Ammendment. Always getting in the way of a safe and happy society. Remember kids nothing is safer than total government control, just look at prision life. I commend the SPD for following the law and things the right way (or at least writing it up correctly)

Why would a search warrant be needed to search a car that had been impounded from an individual that had been arrested already? Have criminals been given more individual rights than law abiding citizens again? Society is doomed. Crooked cops and criminals have more rights than law abiding tax paying citizens. Sounds more serious than if I were talking on my cellphone while driving. Wait, the police do that too.
