Petition filed for Joseph Duncan victim’s estate

KOOTENAI COUNTY-- The father of the victims of convicted killer Joseph Duncan is taking legal action in Kootenai County.

Earlier this year, Steve Groene filed a lawsuit against the aunt of his children, Dylan and Shasta. He said Brandy Hoagland mismanaged a bank account meant for the kids.

We're told Groene is asking to state to decide who is the legal heir of his son's Dylan’s estate.

Court records show Steve Groene and his attorney filed what's called a petition for determination of heir-ship. It asks the state to decide who is Dylan Groene's heir.

Dylan was killed by serial killer Joseph Duncan in 2005. His sister Shasta survived.

The petition to determine his heir was filed on Wednesday.

Earlier this year Groene filed a law suit against Hoagland. He says Hoagland mismanaged a fund that was setup in Shasta and Dylan Groene's name.

Part of figuring out who should control that fund comes from determining who is Dylan's legal heir.

Brandy Hoagland and Steve Groene should be back in court next Friday.
