COEUR D'ALENE -- A Coeur d'Alene City Council election is still not settled and will be discussed in court again on Friday.

There are five votes seperating incumbent Mike Kennedy and the candidate who lost, Jim Brannon.

A private investigtator hired by Brannon says he has found evidence that could swing the tight election -- that some voters used business addresses as home addresses, used old home addresses to vote in the city election, or possibly voted improperly from abroad.

Kootenai County stands behind the election.

Kennedy's attorney says the lawsuit has no merit.

"We're just trying to get to the bottom of how many people voted illegally. If they did it intentionally [or] unintentionally," says Brannon.
