SPOKANE-- A 24-year-old Spokane man is scheduled to face a judge Tuesday on murder charges.

David Fagundes is accused of stabbing a man to death in downtown Spokane this weekend.

Spokane police tell us early Sunday morning, officers found man in the street near Howard and third suffering from stab wounds. The victim died a short time later at the hospital.

Moments after, David Fagundes says he got a knock on his door from investigators. “They said there had been a homicide…I said, I didn't kill nobody.  I don't know what you need with me.”

Fagundes says he knew the man.  He says the victim had been in his apartment about six hours earlier around midnight.  Fagundes says he got marijuana from the man from time to time.

The suspect told us the two of them got into a fist fight. He says the man peppered sprayed him.  During the struggle he says they knocked tools off the wall. “We ended up wrestling and landed on that stuff a couple times. So we was cut up.  I was bloody. He was bloody.”

Fagundes says he eventual fought the man out of his apartment. “He left my house in enough working order to be fighting me and spraying me with mace, so obviously he wasn't dead and he wasn't dying.”

He doesn't know what happened to him next.

Fagundes says there was surveillance camera outside his apartment.  He says he hopes that could help prove his innocence.
