Suspect arrested after scuffle that caused officer to lose gun

SPOKANE, Wash. -- Spokane Police said an officer’s gun was briefly in a suspect's vehicle after an altercation Wednesday.

It happened near the intersection of North Addison and East Columbia. Authorities said the officer was pursuing Samuel Banks, 25, then an altercation occurred. Police said that the officer's gun dropped into the suspect's vehicle when Banks took off. The vehicle was recovered a short time later, and the officer's gun was still inside.

Officials said Banks stole and car and left it on North Mayfair. The car was damaged as well as some property while he was driving. Police believe he was trying to get away from an officer who saw him trying to steal the car and pulled out his gun.

Banks was on the run for nearly six hours but was arrested late Wednesday and booked into jail.  A tip led officers to a home where they took Banks into custody without incident.

Court records say Banks is on a community custody hold and he has not yet been charged with anything. Authorities said he faces several charges including car theft and hit and run.

The man who was with Banks when he was arrested claims Spokane Police are "just exaggerating" and said his friend is not a violent man.

“It all sounds a bit exaggerated and it just doesn’t make sense,” said Banks’ friend. 

Police said no one was injured besides a few cuts to the first officer involved.

Authorities issued a warrant for Banks' arrest on September 12 for failure to report to his supervisor. Banks is currently under supervision for 1st degree burglary and possession of a controlled substance.
