SPOKANE-- A mistrial was declared Monday in court for a man accused of helping his girlfriend kill her ex-husband
Brian Moore faced first degree murder and conspiracy to commit murder charges. Prosecutors say he helped plot the 2007 murder of Dale Stark.
No decision was reached by the jury on Monday. It is up the state to declare if there will be a retrial.
Shelley Stark is awaiting a new trial.
A judge sentenced Stark in 2009 for shooting her husband in the back. The State Appeals Court threw out her murder conviction; she's awaiting trial again.
