LATAH COUNTY, Idaho--Prosecutors in North Idaho said statements made by a woman before she disappeared should be allowed in the murder trial of her estranged husband.

Charles Capone is charged with killing his estranged wife, Rachael Anderson.

The co-defendant in the case, David Stone, had pleaded guilty for failing to notify law enforcement about Anderson’s death.

Court documents said Anderson was in a state of on-going emergency because she did not know who was stalking her.

Authorities said she was lured to a shop owned by Capone in April of 2010 where she was drugged and killed. Anderson’s body has never been found.
