ST. MARIES, ID. -- A man who is accused of murdering his girlfriend had his trial pushed back for the second time.
Investigators say Joseph Hererra is accused of killing Stephanie Comack in 2011 on Christmas day.
It has been 15 months and Hererra still hasn't had a trial. County Prosecutor Doug Payne the recent issue surrounds jury selection. The judge dismissed 3/4 of them because they knew Hererra, Stephanie or their families. They say there's not enough candidates to fill the jury box.
A judge will now have to rule whether or not the trial will move to Kootenai County or try again in Benewah County and bring in more jury candidates.
The ruling should come out next Friday.
