Jury selection in Gail Gerlach trial to begin Monday

SPOKANE, Wash. -- A Spokane man who shot and killed a man who was stealing his SUV was back in court Friday.

Gail Gerlach is charged with First Degree Manslaughter for shooting and killing Brendan Kaluza Graham. He has pleaded not guilty.

Gerlach admitted to shooting Brendan Kaluza-Graham when the 25-year-old tried to drive off in  Gerlach’s 1997 Chevrolet Suburban in March 2013.

The police report said Gerlach left his vehicle running in his driveway near Mission and Lee. Gerlach told police he saw the suspect pull out of his driveway. He followed Kaluza-Graham on foot and allegedly saw the suspect raise his arm. Gerlach said he fired when he thought he saw a gun.

The prosecution wanted one of the defense’s expert witnesses thrown out. A judge denied the motion and a motion for a continuance.
