SPOKANE, Wash. -- Convicted killer John Lipinski is getting a new trial.
Lipinski was found guilty of killing his pregnant girlfriend, Mellissa Saldivar, and their unborn baby in 2004. On Friday, The judge ordered the new trial for Lipinski to start February 3, 2014.
Lipinski's attorney, John Stine, ordered a new trial because in his first trial jury selection was not open to the public and he said that was enough to appeal.
Lipinski's sister said there are two sides to every story.
"Both families have suffered a great deal," Elizabeth Lipinski said Friday. "Melissa was family to us, too. We took care of her."
Those close to Saldivar are still very saddened by their loss.
"I miss her so much. Things are sometimes so hard to bear, I've even begged God to let me leave earth to be with Melissa," said Saldivar's mother, Tina Salvidar.
Saldivar's mother told the court at Lipinski's sentencing that she did not believe a word of his story.
"I don't think you should be set free until you accept responsibility and show remorse," said Saldivar.
