SPOKANE VALLEY, Wash. -- A man accused of causing a wreck in August that killed a 21-year-old woman made his first appearance in court Wednesday.

Prosecutors filed charges in October against Brett Birge, 43.  Birge was set free in the meantime.

Birge finally made an appearance in court in a wheelchair Wednesday morning.  A judge continued Birge’s arraignment so he had time to consult his public defender.  The date for arraignment was set for late November.  Conditions of Birge’s release would also be discussed at his next court appearance.

Investigators say Birge was under the influence when he caused the crash on E. Trent Avenue. The wreck killed Brittany Babinski.

Witnesses said Birge was going at least 20 to 30 miles over the speed limit when his car jumped the median and slammed into Babinski’s car.  She was taken to the hospital and died shortly after.  A third car was also involved in the crash but the driver of that vehicle was not seriously hurt.
