Court appearance for accused local car thief

SPOKANE, Wash. -- The man accused of unknowingly driving away with a Spokane Police officer's service gun was in court on Friday.

Officers arrested Samuel Banks, 25, on Wednesday a few hours after he allegedly stole a car and led them on a chase. Court documents gave insight into how the officer likely lost his gun during an alleged altercation with Banks.

He said he broke a car window as Banks was driving away and that's most likely when it happened. Banks allegedly stole a car and got into a confrontation with police when he was confronted. It was during that run in that an officer somehow lost control of his service weapon and it wound up in the allegedly stolen car that Banks was driving. It was recovered three minutes later.

Court documents also showed the responding officer wrote in his report that Banks frantically started the vehicle against official orders.The officer would also go on to report that Banks sped out of the backyard and through a six foot wooden fence to avoid being arrested. The officer said he recognized Banks immediately but the defense said there's no proof it is him.
