COEUR D'ALENE, Idaho (AP) — A North Idaho district court judge has disqualified himself from an election challenge lawsuit involving a city council contest in Coeur d'Alene.
First District Judge Benjamin Simpson did not give a reason Tuesday for becoming the third judge to remove himself from the lawsuit that was filed in November.
Jim Brannon filed the lawsuit against Mike Kennedy and the city of Coeur d'Alene, challenging Kennedy's five-vote win for a city council seat.
The city has since been dropped from the suit, and Kennedy's attorney has filed a motion to drop Kennedy as well, arguing it was the county that held the election.
Previously, 1st District Judge John Mitchell disqualified himself from the case and Judge Charles Hosack retired.
