SPOKANE COUNTY-- The Spokane County Sheriff’s Deputy who says he had a gun pointed at him during a call says he thought he was going to die.
He says that’s why he and another deputy opened fire on 65-year-old Donald Lafavor.
Court documents say Lafavor knew very well who was at his door that night.
Police say Lafavor was waiting for them and was ready to fire.
On November 28th police say Lafavor had been drinking and fighting with his girlfriend.
When Sheriff’s Deputies arrived, they knocked on the door.
That’s when they say Lafavor answered with a loaded 38 revolver pointed right at Deputy Ryan Walter’s head.
According to court documents, Deputy Walter said the gun was so close he could look down the barrel and even see the bullets in the gun.
Walter told investigators he thought he was going to die, drew his own gun, and fired.
Court documents also claim Lafavor knew there were police on his doorstep before he ever went to grab his gun.
Lafavor’s girlfriend told deputies she saw Lafavor look out the peephole in the front door and then say he was going to get his gun.
She asked him, “are you sure, you’ve been drinking?” He replied with, “yeah.”
Lafavor was hit twice and taken to the hospital.
He has since been released and is in the Spokane County Jail on two charges of first degree assault.
